14 CFR 107.145

Flying a drone over moving vehicles

Part 107 allows flight over people in moving vehicles only in narrow cases. Here is the rule, how it differs from flying from a vehicle, the exam traps and practice questions, with the FAA source under each answer.

Part 107, explained · Last reviewed October 25, 2026 against the eCFR and faa.gov. UAV Campus is not affiliated with the FAA.

Can you fly a drone over people in moving vehicles under Part 107?

Only under one of the four operations-over-people categories. For Categories 1 to 3, the drone must stay within or over a closed- or restricted-access site where everyone in the vehicles is on notice, or must not maintain sustained flight over moving vehicles. Category 4 needs an airworthiness certificate.

(b) For an operation under Category 1, Category 2, or Category 3, the small unmanned aircraft, throughout the operation— (1) Must remain within or over a closed- or restricted-access site, and all human beings located inside a moving vehicle within the closed- or restricted-access site must be on notice that a small unmanned aircraft may fly over them; or (2) Must not maintain sustained flight over moving vehicles.

Exam traps

  • 'Sustained flight' is the key phrase: outside a closed- or restricted-access site, Categories 1 to 3 may not hold sustained flight over moving vehicles.
  • A stationary vehicle is different: 107.39 already allows flight over a person inside a stationary vehicle that can provide reasonable protection.
  • Flying over moving vehicles (107.145) is not flying from one (107.25): from a moving land or water-borne vehicle you may fly only over a sparsely populated area, and not while carrying another person's property for compensation or hire.
  • Category 4 also requires operating within the approved Flight Manual's operating limitations, and those must not prohibit flight over people in moving vehicles.

Try it: practice questions
